1.
Any products/designs of Nicola Bows Designs cannot be reproduced
and sold in any outlet without the written permission under signatures
of an authorised representative of the company. (Company meaning Nicola
Bows Designs)
Products offered by Nicola Bows Designs to any retailer where they
are in a agreement to resale our products within the agreed unit/premises
cannot resale the products in any other unit/premises other than the
retail outlet agreed. 1b. Nicola Bows Designs and
products associated with the company, can only be sold on as a Nicola
Bows Design, where the Products are displayed and sold as agreed must
be clearly seen identified as a Nicola Bows Design product and not
under any other company name or reproduced without permission by any
other persons and then sold on as a Nicola Bows Design. 1c. No works, variation or additional works specified in the schedule
overleaf or invoice for orders shall have effect unless agreed in
writing under signatures of a duly authorised representative of the
company.
Descriptions shown in brochures, advertisements, and by the way of
samples are liable for alteration at any time.
Size and measurements are approximate and subject to alteration.
Due to the nature of products, colours and designs may have slight
variations.
The company may revise prices without notice. quotations and estimates
remain current for one month from date given. ORDERING OF FURNITURE. 2a. Before any orders can commence, customers must pay a deposit as
specified and agreed on order/invoice form to the retailer where products
are sold. Retailer must then pay the required deposit to Nicola Bows
Designs for order to commence.
Nicola Bows Designs will confirm with the customer and retailer in
writing ,acknowledging full details of the products ordered.
Customers have 7 working days to cancel any orders where refunds of
any deposits paid to Nicola bows will be given
(see section 2c) or inform us of any changes required before production
commences unless agreed different by the company representative. or
where sufficient time will allow any changes and cause no affect in
production. 2b.The customer also agrees that when ordering a product from the
company, that payment of all monies due are fully paid on completion
of the order, when products are ready for delivery or collection.
Balance of payment in full including any delivery charges of the total
order value is to be paid within 14 days of the order being completed
and before delivery regardless of any delays of delivery caused by
customer.
Delivery being within 14 days of completion unless otherwise agreed
in writing by the company and customer.
Nicola Bows Designs shall use its best reasonable efforts to deliver
on time within the 14 days of order completed but shall not be held
responsible for any delays caused beyond our control ie fires, strikes,
accidents, delays in raw materials and components where a reasonable
extension of time for delivery shall be granted to the company.

2c. Any
payments made to the retailer by customer for the products of Nicola
Bows Design, should be then paid to Nicola Bows Designs less any deductions
such as commissions for sales, sale or return agreements as agreed
with by the representative of the company and the retailer with whom
they have an association with, unless agreed different in writing
by representative of the company.
In any event where a refund is due, Nicola Bows Designs will only
refund the monies received. Any monies refunded to customer must be
refunded from either retailer or supplier who are in receipt of customers
payments or part payments at the time. Nicola Bows Design cannot be
held responsible for refunds for any payments or part payments that
have not been received from retailer and any payments made to retailer
such as commissions, sale and return agreements, that have not been
refunded to Nicola Bows Designs and in this case, refunds will need
to be obtained from retailer. Any refunds where the retailer has paid
the customer and where Nicola Bows Design are in receipt of the payment,
will reimburse the retailer, less any commissions, sale and return
agreements paid once products have been returned to Nicola Bows Designs
by customer/retailer . 2d. Cash payment can only be accepted on delivery if agreed by all
parties concerned, meaning retailer and supplier and is within the
time limit of full payment due. and paid direct to Nicola Bows Designs.
Payments by cheque must be paid and cleared within 5 working days
to Nicola Bows Designs before an arranged delivery date is made. This
does not include days paid to retailer.
Cheque payments cannot be accepted on day of delivery.
Payments by way of credit card for the products must be paid to retailer.
Nicola Bows Designs are not liable for any credit /debit card charges
incurred for payments of orders by the customer, sold through any
retail outlets.
All goods will remain the property of Nicola Bows Designs until full
payment is received. 2e. Nicola Bows Design has the right
to cancel any order where the company cannot continue with the order
due to circumstances beyond our control, where a full refund of any
monies paid by the customer will be given (see section 2cabove)
Refunds or replacement will be given if the product is found faulty/damaged
at the time of delivery/collection on inspection at time of delivery
or within a reasonable time after their delivery ( and in any event
within three days). No refunds or replacements will be given for fair
wear and tear, misuse and accidental damage by user/users or if they
decide they no longer want the items.
Risk ,damage and loss to goods shall pass to the buyer at time of
delivery. Your statutory rights are not affected
